LABOR CODE §132a & SERIOUS & WILLFUL MISCONDUCT

Labor Code §132a prohibits employers from terminating, threaten to terminate, or discriminating against employees who have filed or intend to file a workers’ compensation claim. When successful, these claims can result in significant legal penalties. Employers who have been accused of serious and willful misconduct by an employee are often facing serious legal consequences including a significant increase in compensation payable to an injured employee.
